April 10, 2017
CBJ ASSEMBLY says no to
fireworks ordinance. By a 5-4 vote, the Assembly voted to
make the fireworks issue go away. The vote was held at the
Committee of the Whole meeting held tonight (April 10). The
Assembly decided that it was tired of the issue and did not want
to discuss fireworks any more. The Assembly did not want
to wait until after the 4th of July to get a full report on
fireworks from the Juneau Police Department.
SUPPLEMENTAL INFO: The motion to cancel further...
consideration of the fireworks issue was made by Assembly member
BECKER. Voting in favor of the motion was: BECKER, NANKERVIS,
KOELSCH, WHITE, and GREGORY. Voting against the motion were:
JONES, GLADZISZEWSKI,, KIEHL, and WELDON. The minutes of
this portion of the meeting should be interesting because the
discussion was disjointed and fragmented. It would be hard to
summarize the discussion for the minutes and a verbatim
transcript of the discussion of the motion could be hard to
follow.

GUIDELINES FOR FIREWORKS USE IN THE CITY AND BOROUGH OF
JUNEAU
October 31
At it's Committee of the Whole meeting on
Monday, October 31, the CBJ Assembly voted to postpone further consideration of a proposed fireworks ordinance
until April 2017. In the meantime, Juneau Police Department is directed to make a concerted effort to enforce the noise ordinance.
JPD will seek voluntary compliance with noise ordinance. Failure to voluntarily comply will result in citation.
Most days of the year, JPD will respond to complaints about fireworks after 10 pm. On Fourth of July, JPD probably would respond to fireworks after 1 am. Not sure how JPD will respond to fireworks complaints
during daylight hours.
The Assembly will review the effectiveness of the noise ordinance in April before considering the proposed firework ordinance again.

Public Meetings About Fireworks
At the direction of the CBJ
Assembly, the City Manager held two meeting to take public
comment on a proposed ordinance regarding fireworks in
Juneau.
The first meeting was held in
town at the Assembly Chambers. The other meeting was
held in the Valley at the Valley Library. The meetings
were not recorded but the city clerk did take notes of the
proceedings and did collect documents submitted during the
meetings.

Grateful Dogs of Juneau is on record as supporting a complete ban on consumer fireworks in in Juneau. GDOJ has not opposed the usual public fireworks shows on the Fourth of July and New Years.

PRAC Committee Adopts Recommendation on Fireworks in Parks
The CBJ Parks and
Recreation Advisory Committee adopted its recommendations for
useof fireworks in CBJ park areas at is special meeting on September 9.
The PRAC Adopted this
position on fireworks:
“The PRAC recommends to the CBJ Assembly that the use of all
fireworks on CBJ managed parklands are prohibited at all
times with the following exceptions (1) July 3rd & July 4th
(2) December 31st & January 1st, (3) and other dates
permitted by the Parks & Rec Director. During these periods
the use of consumer fireworks (1.4G) is allowable on all CBJ
parklands consistent with park open hours.”

Assembly Discussed Fireworks Ordinance.

Monday, August 15, meeting
At the CBJ Assembly meeting on Monday, August 15 the Assembly decided to propose a municipal ordinance regarding fireworks in Juneau. The Assembly asked the municipal attorney to draft a proposed ordinance on fireworks somewhat based on the recommendations of the city manager. (See below for discussion of the city managers proposal.)
The proposed ordinance requested by the Assembly would limit the use and possession of consumer/salable fireworks to brief periods around the Fourth of July and New Years. Fireworks could not be used during the hours of 1 am till 10 am. The fine for violating the ordinance would be $300.
The assembly did not accept the manager's proposal to ban aerial fireworks.
The proposed ordinance will not be considered by the Assembly until the October 10 Committee of the Whole meeting.
August 15
City
Manager Proposes Restrictions on Fireworks
The
city manager has proposed action in regard to consumer use of
fireworks. The proposal includes seasonal times when fireworks
are legal and restrictions on the types of fireworks that would
be permitted. The proposal outlines an enforceable strategy to
limit the use of fireworks in the community.
The proposal does not
include a ban on consumer fireworks.
